TERMS AND CONDITIONS

Hello, this document is provided to you as a potential participant in our retreats and as a user of the RISE Collective (“RISE Collective”, the “Company”, the “Organiser”, “we”, “us” or “our”) website, www.risecollective.life, and any other sites we operate now and in the future ("our Sites").  Our Sites contain, among other things, information regarding our Psychedelic Retreats and various related services. Use of our products, software, services and Sites (referred to collectively as the “Services”) by our visitors and participants (collectively, “Participant”, “Client”, “Guest, “You” or “Your”) is subject to these terms and conditions (the “Terms of Use”) and form a binding agreement between You and us.

Each time you access the Sites or use the Services, you're agreeing to these Terms of Use. If you don't agree to all of these Terms of Use, you'll have to stop using our Sites and Services.

Our Sites and everything on them, including all materials presented and all online services provided by RISE Collective, are subject to these Terms and Conditions. These apply to all site visitors, customers, and all other users of the Site or Services. 

By using the Site or our Services, you agree to these Terms and Conditions and acknowledge you've read and understood them.

CHANGES TO THESE TERMS OF USE

We can change these Terms of Use at any time. The changes will apply once they've been posted on the Sites. If you keep using the Sites after that, it means you've accepted any changes we've made. If you want to contact RISE Collective, you can email us at contact@risecollective.life.

USE OF THE SITE AND SERVICES

To use the Site, you must be at least 18 years old and be able to enter into these Terms and Conditions. Those under 18 are not allowed to use the Site. The Site and the Services have information about retreat experiences involving the use of psychedelic substances. This information can change and is not medical advice.

USE OF THE WEBSITE

The information on this website is for your use and information. It can change without warning. We and any third parties don't guarantee that the information and materials on this website are accurate, timely, complete, or suitable for a specific purpose. You accept that the information and materials may contain mistakes or errors. Your use of the information or materials on this website is entirely at your own risk.

PAYMENT

To confirm your booking with us, you'll need to pay the total price of your booking. If something unexpected happens that stops the event from happening or stops you from attending, you can simply apply your payment to a future event or transfer it to another qualifying participant. Payments are non-refundable.

YOUR BOOKING

To confirm your booking, you must take part in our intake process and qualify for our Services. Also, your booking isn't fully confirmed until we've received full payment.

CANCELLATION OF A RETREAT BY RISE Collective

RISE Collective can cancel any retreat for any reason, but we won't cancel a retreat less than 60 days before the start date unless it's due to unforeseen circumstances beyond our control. In the event that we need to cancel a retreat date, through no fault of your own, you can either:

• Move your deposit to another future event or session, or
• Get a full refund of all money you've paid.

We're not responsible for any extra costs or losses you may have due to the booking, like visas, vaccinations, non-refundable travel costs, non-refundable parking fees, loss of income, or loss of enjoyment, etc. If you request a different retreat date or session that costs more than the one you originally booked, you must pay the difference in price.

TRAVEL: PASSPORT, VACCINATIONS, VISAS, TRAVEL ADVISORIES & WARNINGS

All travel requirements are your responsibility. You need to make sure you're eligible and have all necessary travel documents for your trip, like a valid passport, vaccinations, and any other official identification documents. RISE Collective isn't responsible if you're refused entry to a country. You're also responsible for checking if any immunizations are needed or recommended for travel in the country or region(s) you're visiting. You're also responsible for researching the safety and security conditions in the country and/or region(s) you're visiting during your travel, and for being aware of any travel advisories and/or warnings.  

TRAVEL & HEALTH INSURANCE

RISE Collective requires you to have travel medical insurance. This insurance must cover personal injury and emergency medical expenses, including, but not limited to, helicopter evacuation, air ambulance, and repatriation. We strongly recommend that you extend your coverage to include cancellation, cutting your trip short, and all other expenses that might come up as a result of loss, damage, injury, delay or inconvenience during travel. RISE Collective doesn't provide insurance.

REFUSAL OF SERVICE

We offer our services based on our acceptance of your application and payment. We can refuse to provide service to anyone, without having to give a reason. We can also change or stop any part of the Site or Services at any time, as long as we fulfill our previous responsibilities to you based on accepting your payment.

Our directors, local guides or other representatives will always have the final say on all matters that could affect the safety and well-being of the guests and the session. We can ask any guest to leave the retreat and stop any guest from staying in the RISE Collective location(s) and surrounding private areas with no refund if we think that guest's actions are a risk to the safety of others, to wildlife, to themselves, or if the guest's actions or behaviour are adversely affecting the event or session for others.

Each instructor leading an event or session or Third-Party Operator can also refuse to let any of their guests take part, if they think the client's continued participation will disrupt or harm the overall experience, the other clients, property, or suppliers.

If a client is denied participation after the event’s start date, RISE Collective isn't responsible or liable for any costs incurred due to being expelled. Individuals asked to leave will not be refunded.

ALCOHOL & INTOXICATING SUBSTANCE CONSUMPTION

At RISE Collective, we don't tolerate intoxication, alcohol consumption, or the use or possession of intoxicating substances. Clients must notify staff of all medications (including cannabis) that they are prescribed to take regularly. Any client who drinks alcohol, is intoxicated, or uses or has intoxicating substances, including non-reported painkillers and intoxicating prescription medication, on the RISE Collective premises or surrounding public and private areas may be asked to leave immediately. They won't be refunded for the remaining time or days of their session. RISE Collective isn't responsible or liable for any costs due to an alcohol or substance-related dismissal.

MEDICAL CONDITIONS + SPECIAL REQUIREMENTS

When you're booking (on your registration form), you must tell us in writing about any medical conditions, pregnancy, disability, or any other mental or physical condition that might affect your fitness to travel and/or any medical condition. If you don't tell us, you might be refused service without a refund. Certain activities or substances during the retreat might not be suitable for you due to physical or mental conditions. It's your responsibility to give us accurate, up-to-date information about your health. We do our best to meet clients’ special requests, including dietary restrictions, cannabis use, etc... but such requests may not be able to be fulfilled. So, RISE Collective isn't liable for not providing these requests. Medical facilities differ from place to place and country to country, and we make no promises and give no guarantees about the standard of such treatment. You are required to obtain and are responsible for medical travel insurance. 

ITINERARY & CHANGES

The itinerary listed for each event is a general plan, including the daily schedule of activities. However, you acknowledge that you'll arrange your retreat days according to your personal comfort levels and only participate in what you feel comfortable with. If our itinerary changes, we'll work with suppliers or coordinators to reschedule the retreat plan. These changes could include, but aren't limited to, changes in the itinerary, quality or location of lodging, modes or quality of transportation, etc. You understand and agree that: RISE Collective or its designees may make last-minute or on-site decisions to address changed circumstances, and RISE Collective reserves the right to change the itinerary without notice to you.

PHOTOS AND MARKETING

During the program, photos or videos may be taken by participants or facilitators. We endeavour to take non-identifying images and we do not share images that may identify any participant without their express consent. These images may be used in our materials, website, social media platforms, etc., unless you specifically request us or the photographer not to do so. Otherwise, you grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes. Please email contact@risecollective.life to request your image not be included.

THIRD PARTY OPERATORS

"Third Party Operators" are independent contractors, such as, but not limited to, lodging facilities, airlines, ground or water transportation, tour operators, food service providers. RISE Collective doesn't own, operate or control any person, property, or entity providing any goods or services. We work with Third Party Operators to provide all goods and services for your event. We try to select reliable suppliers and contractors with high standards of service, but we won't be responsible or liable for any actions or omissions of any Third Party Operators.

PRIVACY POLICY & DATA PROTECTION

Your medical data is collected on HIPAA compliant platforms.

Uses Of Your Information

1. We use the Personal Data that we receive to operate the Sites, produce our Events, and in certain other ways, including:

• provide improved administration of the Sites and Services;
• provide the Services You request;
• improve the quality of experience when You interact with the Sites and Services;
• send You administrative e-mail notifications, such as security or support and maintenance advisories;
• to send newsletters, surveys, offers, and other promotional materials related to our Services and for our other marketing purposes .

2. We do not rent, sell, or share Your personal information with any other entity, except when:

• We have Your permission; or
• We respond to subpoenas, court orders, or other legal process; or when we must exercise our legal rights, protect our property, defend against legal claims, or otherwise comply with the law, or
• You book a retreat and other products or services online at the Sites, and Your order is processed in collaboration with a third party company, which are instructed to not share or sell Your information.
• In the unlikely event that RISE Collective is acquired or transferred, or changes entity status through any type of transaction (including an asset sale, merger or bankruptcy), all personal information will be amongst the transferred assets.

COMPLAINTS

Should you encounter any issues with the Services provided by RISE Collective, we encourage you to bring it to the attention of our team immediately for resolution. If the problem persists or was not satisfactorily resolved, please provide us with a written complaint within 28 days of your return, detailing the issue and any relevant information. Please note, failure to follow this procedure limits our opportunity to address and rectify the issue while you were receiving our Services. We cannot assume responsibility for the individual behavior of any group member, other guests at your accommodation, Third-Party Operators or circumstances beyond our control.

DISCLAIMER

RISE Collective offers this Site as an informational resource. The Content shared on this Site or in any interaction with RISE Collective is not intended to replace professional medical advice, diagnosis, or treatment for specific medical conditions. You assume all responsibility for your use of the Content and our Services. Always consult your physician or a qualified healthcare provider for any medical queries you may have.

RISE Collective does not guarantee the results of following the recommendations provided and any statements about potential outcomes are merely opinions. We offer no guarantees concerning the information and recommendations shared. By continuing to use, read, or participate in the Site and Services, you acknowledge that we cannot guarantee specific outcomes as they are based on subjective factors beyond our control. Therefore, using any information or recommendations provided on the Site is at your own risk. If you require professional medical advice, counselling, or therapy, it is your responsibility to engage the services of a licensed professional.

ACKNOWLEDGMENT OF RISKS AND ASSUMPTION OF RESPONSIBILITY

You acknowledge and understand the inherent risks associated with participating in the Services provided by RISE Collective, which may include the use of psychedelic substances, the regulation of which may vary depending on the location of the retreat. These risks encompass but are not limited to illness, injury, death, legal consequences, and potential long-term mental or physical health effects. Additionally, you recognize that certain Services offered may have lasting implications for your mental or physical well-being.

By choosing to engage in these Services, you do so with full awareness of these inherent risks. You hereby accept full responsibility for any injury, death, loss of personal property, and the consequences of life choices made after the retreat that may arise, as well as any expenses incurred as a result of these risks. You understand and acknowledge that RISE Collective and its affiliates cannot be held liable for your personal decisions and actions during or following your participation in our retreat.

INDEMNIFICATION

You agree to indemnify and hold RISE Collective, its officers, directors, employees, agents, heirs and affiliates harmless from and against any claims, liabilities, damages, losses, and expenses, including legal and accounting fees, resulting from your access to or use of the Services, or your violation of these terms. 

ACKNOWLEDGMENT

You confirm that you have read, understood, and agree to be bound by these terms and conditions, as presented to you via your intake form, as well as any future modifications.

LIMITATION OF LIABILITY

You understand and agree that RISE Collective shall not be liable for any direct, indirect, incidental, consequential, special, punitive, exemplary, or any other damages arising out of your use of the Services. This includes, but is not limited to, any failure of performance, error, omission, denial of service, attack, interruption, deletion, defect, delay in operation or transmission, computer virus, or line or system failure; loss of revenue, anticipated profits, business, savings, goodwill, or data; and third-party theft of, destruction of, unauthorized access to, alteration of, or use of your information or property.

FORCE MAJEURE

RISE Collective shall not be liable for any changes, cancellation, effect on your booking, loss, or damage, or for any failure to perform due to events beyond its control, such as war, revolution, terrorist act, closure of borders, epidemic, natural catastrophe, or other unforeseeable causes.

SEVERABILITY

If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

ENTIRE AGREEMENT & WAIVER

These Terms and Conditions represent the entire agreement between you and RISE Collective regarding your use of the Site and Services, superseding any prior agreements. No waiver of any provision of these Terms and Conditions shall constitute a waiver of any other provision, whether or not similar.

ASSIGNMENT

You may not assign, delegate, sublicense, or otherwise transfer your rights and obligations under these Terms and Conditions. Any attempt to do so shall be invalid. By confirming your booking with us, you agree to these terms, you acknowledge that you have read, understood, and agree to be bound by them, indicating your acceptance of these terms and conditions and all inherent risks.
